Terms of service
TERMS OF SERVICE
Last updated: 3 September 2026
1. ABOUT THESE TERMS
Welcome to PITAARA.
These Terms of Service ("Terms") apply to your use of the PITAARA website and to purchases made through our online store.
In these Terms, "PITAARA", "we", "us" and "our" refer to PITAARA, and "you" and "your" refer to the person using our website or purchasing our products.
By using our website or placing an order, you agree to these Terms, together with our other applicable policies, including our Privacy Policy, Returns & Refunds Policy and Shipping & Delivery Policy.
Please read these Terms carefully before placing an order.
2. OUR PRODUCTS
PITAARA sells apparel designed around our "Desi Pride, Angrezi Vibe" concept.
We make reasonable efforts to ensure that product descriptions, images, colours and other information on our website are accurate. However, colours may appear slightly different depending on your device, screen settings and other factors.
Product measurements may vary slightly between products. Please refer to our Size Guide and the measurements provided for the relevant product before ordering.
We reserve the right to update product descriptions, designs, availability and pricing where reasonably necessary.
Nothing in these Terms affects your legal rights as a consumer. Our products will be as described, of satisfactory quality and fit for purpose as required by law.
3. PLACING AN ORDER
When you place an order through our website, you are making an offer to purchase the selected products.
After placing an order, you will receive an order confirmation acknowledging that we have received your order. This does not necessarily mean that your order has been accepted.
Your order is accepted when we confirm that it has been accepted and/or when the products are dispatched, as applicable.
We may refuse or cancel an order where there is a genuine reason to do so, such as a product being unavailable, an obvious pricing or listing error, suspected fraudulent activity, or an inability to fulfil the order.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
4. PRICES AND PAYMENT
All prices displayed on our website are shown in pounds sterling (£), unless otherwise stated.
The price payable for a product is the price displayed at the time you place your order, subject to obvious errors.
We accept the payment methods made available through our checkout.
You must provide accurate and complete payment and contact information when placing an order.
If a pricing error is discovered after an order has been placed, we will contact you where reasonably possible and provide you with the appropriate options, including cancellation and refund where applicable.
5. MADE-TO-ORDER PRODUCTION
PITAARA products may be produced to order through our production and fulfilment partners.
This means that your item may only be produced after your order has been placed rather than being held as pre-made stock.
Production and fulfilment arrangements may vary depending on the product and delivery destination.
The fact that an item is made to order does not remove any statutory rights you may have under applicable consumer law.
Where a product is genuinely personalised or customised at your request, any applicable legal exception to cancellation rights will be explained to you where relevant.
6. SHIPPING AND DELIVERY
We currently offer free UK shipping on eligible PITAARA products, as stated on our website.
Delivery estimates are provided at checkout or in our Shipping & Delivery Policy. These are estimates rather than guaranteed delivery dates unless we have expressly agreed otherwise.
We use third-party production and delivery partners and shipping carriers to fulfil orders.
While we will take reasonable steps to ensure your order is delivered, delays can sometimes occur due to circumstances outside our reasonable control, including carrier delays, customs processes, severe weather, strikes or other unforeseen events.
Nothing in this section limits your legal rights if an order is not delivered within the period required by law or within a specific delivery period agreed with you.
For further information, please see our Shipping & Delivery page.
7. RETURNS, REFUNDS AND FAULTY PRODUCTS
Our Returns & Refunds Policy explains how returns, refunds and product issues are handled.
Nothing in our policies or these Terms limits your statutory consumer rights.
If a product is faulty, damaged, incorrectly supplied or does not conform to the contract, please contact us as soon as reasonably possible so that we can investigate and provide an appropriate remedy.
Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction or refund.
Where you have a statutory right to cancel an online purchase, that right will apply unless a specific legal exception applies.
For full details, please see our Returns & Refunds page.
8. INTELLECTUAL PROPERTY
All content on the PITAARA website, including our name, logo, designs, graphics, photographs, text, product artwork and other original materials, belongs to PITAARA or is used with permission.
You may access and use our website for personal, non-commercial purposes.
You must not copy, reproduce, modify, distribute, sell, publish or commercially exploit PITAARA content or designs without our prior written permission.
PITAARA and associated branding, names, designs and slogans may constitute trademarks or other intellectual property rights belonging to PITAARA or their respective owners.
9. WEBSITE USE
You agree to use our website lawfully and responsibly.
You must not:
- use our website for fraudulent or unlawful purposes;
- interfere with the operation or security of our website;
- attempt to gain unauthorised access to our systems;
- introduce malicious code, viruses or harmful material;
- copy or exploit our website or its content for commercial purposes without permission; or
- use our website in a way that could damage PITAARA, our customers or our service providers.
We reserve the right to restrict access to our website where reasonably necessary to protect our business, customers or systems.
10. THIRD-PARTY SERVICES
We use third-party providers to help operate our store, process payments, produce products, fulfil orders and deliver products.
These providers may process information necessary to provide their services.
Our website may also contain links to third-party websites. We are not responsible for the content, availability or practices of third-party websites that we do not operate.
11. WEBSITE AVAILABILITY AND INFORMATION
We aim to keep our website accurate, secure and available, but we cannot guarantee that it will always be uninterrupted or free from errors.
We may occasionally need to suspend or modify parts of the website for maintenance, security or operational reasons.
We may correct typographical errors, inaccuracies or omissions relating to products, prices, availability or other information.
Any such correction does not affect rights that have already arisen under applicable law.
12. OUR LIABILITY
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.
In particular, nothing in these Terms affects your statutory rights relating to products that are faulty, not as described or otherwise fail to meet requirements imposed by applicable consumer law.
Subject to the above, we will only be responsible for losses that are reasonably foreseeable and arise directly from our breach of these Terms or our failure to meet our legal obligations.
We are not responsible for losses that could not reasonably have been expected to result from our actions or for circumstances outside our reasonable control.
Nothing in these Terms affects your rights where applicable law provides otherwise.
13. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delays or failures caused by circumstances outside our reasonable control.
These may include natural disasters, severe weather, fire, power or internet failures, strikes, industrial disputes, carrier disruption, customs delays, government action, or other events that could not reasonably have been prevented.
Where such an event affects an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version displayed on this page will be the current version.
If we make significant changes, we will provide appropriate notice where required by law.
Changes will not affect rights or obligations that arose before the updated Terms came into effect.
15. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales, unless applicable consumer law in your country of residence requires otherwise.
If you are a consumer, you may also have rights to bring a claim in the courts of the part of the UK in which you live, where applicable.
Nothing in this section removes any mandatory consumer protections that apply to you.
Important: use the England and Wales wording above only if that is the appropriate jurisdiction for the business. If PITAARA is based in Scotland or Northern Ireland, this section should be changed accordingly.
